Welcome to the Address Lookup API (the "Service"). These Terms of Service ("Terms") govern your access to and use of the Service provided by Prometheus Computing Ltd, a company registered in Wales ("we," "us," "our").   • Enforcement: Any attempt to download the data en masse without authorization will result in the immediate termination of your access to the Service and may lead to legal action against you.

8. Availability and Service Level

  • Service Availability: We aim to provide a 99.99% uptime for the Service. However, we cannot guarantee uninterrupted access and availability of the Service.
  • Scheduled Downtime: We may need to schedule downtime for maintenance, updates, or other necessary activities. We will endeavour to provide advance notice of any scheduled downtime.
  • Unexpected Downtime: We are not liable for any losses or damages resulting from unexpected downtime or interruptions to the Service, whether caused by technical issues, cyber-attacks, or other unforeseen events.

9. Termination

  • Termination by You: You may terminate your use of the Service at any time by discontinuing access and use.
  • Termination by Us: We may suspend or terminate your access to the Service at any time, with or without cause or notice.
  • Effect of Termination: Upon termination, your right to use the Service will immediately cease, and you must delete any copies of the API documentation and related materials in your possession.

We disclaim all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by UK law.

11. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Wales and England, without regard to its conflict of law principles.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the Chartered Institute of Arbitrators (CIArb), to be conducted in Wales. The arbitrator's decision shall be final and binding.

14. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
